Terms of Use for PinFrame

1. Who We Are

PinFrame is a visual place-planning and organization platform that helps users save places with photos, notes, tags, collections, and shareable public profiles.

In these Terms, “PinFrame,” “we,” “us,” and “our” refer to the operator of PinFrame.

2. Eligibility

You may use PinFrame only if:

• You are at least 13 years old (or the minimum age required in your jurisdiction), and
• You can legally agree to these Terms.

If you are using PinFrame on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

3. Your Right to Use PinFrame

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal or internal business use.

You may not:

• Copy, modify, or distribute the Services except as allowed by law
• Reverse engineer, decompile, or attempt to extract source code (except where prohibited by law)
• Use the Services for unlawful, harmful, or fraudulent activity
• Interfere with or disrupt the Services
• Bypass access restrictions, paywalls, or subscription controls
• Use PinFrame to store or share content that infringes someone else’s rights

We may suspend or restrict access if you violate these Terms.

4. Accounts

You may need to create an account to access certain features of PinFrame, including syncing data across devices, subscriptions, or public profile features.

You are responsible for:

• Providing accurate account information
• Keeping your login credentials secure
• All activity that occurs under your account

You must notify us promptly if you believe your account has been accessed without authorization.

We may suspend or terminate accounts that violate these Terms.

PinFrame stores and processes user data on our servers in order to provide core functionality, which may include:

• Saving and syncing spots, photos, notes, tags, and collections
• Managing public profile pages
• Supporting account access and subscriptions
• Maintaining backups, security, and service reliability

While we take reasonable steps to protect your data, no system is completely secure or error-free. You are responsible for maintaining your own copies/exports of important content if needed.

7. Subscriptions, Free Trial, and Billing

7.1 Paid Features

Certain features of PinFrame require a paid subscription (“Pro”). Subscription options may include monthly and yearly plans. Pricing and plan details are shown in the app before purchase.

7.2 Free Trial

PinFrame may offer a free trial period (for example, 7 days). If you start a free trial, billing will begin automatically at the end of the trial unless canceled in accordance with your app store’s policies.

7.3 Billing and Renewal

Subscriptions are billed through Apple App Store or Google Play (or other authorized app marketplaces), not directly by PinFrame.

By purchasing a subscription, you agree that:

• Your payment will be charged by the app store provider
• Your subscription may auto-renew unless canceled before renewal
• You can manage or cancel your subscription through your app store account settings

7.4 Refunds

Refunds are handled by the applicable app store provider and are subject to that provider’s refund rules. PinFrame does not control app store billing or refunds.

7.5 Restore Purchases

If you previously purchased a subscription on the same app store account, you may be able to restore access using the “Restore Purchases” feature.

8. Public Profiles and Sharing Features

PinFrame may let you create public profile pages or public share links to display selected spots and collections.

By using public sharing features, you understand and agree that:

• Public content may be viewed by others
• Public content may be shared further by third parties
• Public content may appear in search engines or previews
• You should not publish private, confidential, or sensitive information unless you are comfortable making it public

PinFrame may remove or restrict public content that violates these Terms.

9. Acceptable Use

You agree not to use PinFrame to:

• Violate any law or regulation
• Harass, abuse, threaten, or harm others
• Store or distribute unlawful or infringing content
• Attempt unauthorized access to accounts, systems, or data
• Upload viruses or malicious code
• Scrape, crawl, or abuse public profile pages in a way that harms the service
• Interfere with service performance or security

We may investigate and take action, including suspension or termination, for violations.

10. Intellectual Property

The Services, including the PinFrame name, branding, design, software, and all related materials (excluding your content), are owned by PinFrame or its licensors and are protected by intellectual property laws.

These Terms do not give you any ownership rights in PinFrame or its branding.

You may not use the PinFrame name, logo, or brand assets without permission, except as allowed by law or by our written guidelines (if provided).

11. Third-Party Services and Links

PinFrame may interact with or link to third-party services, including:

• Apple App Store / Google Play
• Authentication providers (if enabled)
• Payment and subscription infrastructure
• Mapping, geolocation, storage, or hosting providers
• Third-party links shown in public profiles or support content (if applicable)

We are not responsible for third-party services, their content, or their practices. Your use of those services is governed by their own terms and policies.

Your use of PinFrame is also governed by our Privacy Policy, which explains how we collect, use, store, and protect data. Please review it carefully.

13. Service Availability and Changes

We may update, improve, modify, suspend, or discontinue parts of the Services at any time, with or without notice.

We do not guarantee that the Services will always be available, uninterrupted, secure, or error-free.

14. Disclaimer of Warranties

To the maximum extent permitted by law, PinFrame is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that:

• The Services will meet your requirements
• The Services will be uninterrupted or error-free
• Data loss will never occur
• Any defects will be corrected immediately

15. Limitation of Liability

To the maximum extent permitted by law, PinFrame and its operators, affiliates, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or business opportunities arising out of or related to your use of the Services.

To the maximum extent permitted by law, our total liability for any claim related to the Services will not exceed the amount you paid (if any) for PinFrame in the 12 months before the claim arose.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

16. Indemnification

You agree to indemnify and hold harmless PinFrame and its operators from and against claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:

• Your use of the Services
• Your content
• Your violation of these Terms
• Your violation of any law or third-party rights

17. Termination

You may stop using PinFrame at any time.

You may stop using PinFrame at any time, and may delete your account using the in-app account deletion feature where available.

We may suspend or terminate your access to all or part of the Services if we reasonably believe you violated these Terms or if required for legal, security, or operational reasons.

Sections that by their nature should survive termination will survive (including ownership, disclaimers, limitations of liability, indemnification, and dispute terms).

18. Changes to These Terms

We may update these Terms from time to time.

If we make material changes, we may notify you by updating the “Last Updated” date, posting notice in the app or website, or using other reasonable methods.

Your continued use of the Services after updated Terms become effective means you accept the updated Terms.

19. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles, unless otherwise required by applicable law.

Any disputes arising out of or relating to these Terms or the Services will be resolved in the state or federal courts located in New York, New York, unless applicable law requires otherwise.
